    Disco Pranged thats me out!

    Howdy all a couple of weeks before christmas i was in a prang in Parramatta where some Sri Lankan National whilst driving on his Sri Lankan licence turned right at a no right turn intersection across in front of me causing me to T bone him.

    So the Bullbar on my 93 disco took most of the brunt of the prang but screwed the bonnett, and lhf guard grille and headlight surround in the process.

    I got a quote done ther other day - 7 odd grand was the damage - so expecting my vehicle to be written off today i called his insurance co ( i changed mine to third party property this year owing to the low agreed value of my car) Im told by his insurer that althouygh they can assess the claim they cant sign off on the repairs / write off until he pays the excess.

    The best part is yet to come ole mate doenst have the $1100 excess - recons it will take him 22 months to pay it off they wont wear that and will close the claim in three months without fixing my car if he doesnt pay up- how much does this suck!

    SO lemme re cap take out insurance policy cause accident dont pay excess walk away scott free, back on your sri lankan licence and student visa.

    i guess my only option is take out some type of writ or small debit summons but thats costs money and he has none - id probably spen 1/2 the pay out getting themoney in the first place.....I might be able to do this myself as im not unfamiliar with the inside of a court room but civil matters are out of my league!

    Yes today was a bad day!

    Oh while im here can everyone please check my want ad in the marketplace and see if you have some parts to help me out?

    There are ways (legal) that wont cost to much and what it does you can claim back from him I amd familiar with the court process as I held a commercial agents lic for 15 years (debt collector) PM me if you need any help but dont wait for him get him while he has insurance

    Mate it was reported they did come but they shonked it off as a p5 - self reported acco. I made the report to PAL - police assistance line but they only take vehicle registaration time date place i guess what im worried about most is he is a non resident on a os drivers licence and i have no way of confirming his details im also worried he may leave OZ.

    Good to see you back here mate.
    That sucks though. As booger said, you definately have options, whilst the worm still has insurance.

    Booger - pretty sure the police would know

    Have you rang your insurance mob Mick???
    Even though yours is third party,you were not at fault.
    If you have other policies with them they may be negotiable on pressing a claim for you.

    I'm no expert here but I would have thought that by not paying the excess would only affect the claim for his vehicle.

    As for you, if he is clearly in the wrong I would have thought that you would be able to claim against his insurance regardless.

    Have you sought legal advice?

    PAL sucks we get asked to use it all the time for B&Es etc clients get real peeved, so he had no nsw or international lic should have been done for no lic

    That ****s me to tears. That is why now, when people have so called "minor/no injury" accidents, they leave the cars in situ - in many cases - causing untold traffic delays - because if they move them, when the cops turn up they say "it was driven from the point of impact, just report it to insurance via PAL..see ya..." regardless if it is subsequently towed.
