    motor Insurance Discrimination

Ok!!!! it must be because I own a Land Rover.
Had XXXXXX car insurance for over a year now, but let it lapse as the Defender was off the road for about 4 mths.
Reinsured it and all was good till I needed it
So it goes like this, Defender was rear ended by a company vehicle, said company took complete responsibility for the accident..........then we were railroaded by their own insurance company (OOOOOO) who will only deal with our own insurance company.....After their vehicle assessor had a issue with us getting quotes from Land Rover repairers, wanted me to take it down the road to someone he chose (not a OOOOO policy by the way) they don't have proffered repairer.
Anyway called XXXXXX and was advised that due to a default payment the policy was again cancelled.
After a bit of coaxing and put on hold so they could confer with Manager, new policy was established and redirected to claims.
Finished up and was told "please wait 2 working days for our own a assessor to contact you".
After waiting 3 days and still no call, I called them and was told that due to non payment, was unable to proceed with claim, advised and gave Ref No. of direct withdrawal from our account.
Then was told that will have to wait for confirmation of payment.
Called next day and was told by same person "After assessing the policy and claim we will not continue with them" "WHAT!!!!" "WHY?????" "Just because"
So the Mrs gets on the phone to her and long story short was talked over and laughed at, MRS "Not happy Jan".
Well not good enough, so called back talked to someone else (at this stage no one will pass it on to higher level when asked)"That's not right I will look into it and get back to you" "yeah right".... get a call this afternoon with same notice "we are cancelling your policy and claim and all monies returned" again "WHY???" "because, to our company policy" Please explain "Don't have to"
Mrs gets on the phone (Handles Multi million dollar accounts at work so no one is going to pull the wool over her eyes).
And was told the same thing.....HAA HAA HAAA!!!!!! Now the fun begins, and was told same thing....well that that wasn't good enough now was it, so the fun begins.... i could bore you with the small details but I won't, all I have to say is there was a lot of government regulations and company rules to adhere to and broken contracts and the such, being thrown down the phone line.
So at this time we're told that "Theres going to be an internal investigation"
    "Yeah Right" there is!!!!!!!
So we are no closer to getting our Defender fixed.
How they went from that to this is beyond me, it wasn't even going to cost them anything all we needed them to do is just sort it out with OOOOOO for us.
Now if I owned a Toyota I wonder if it would have been different?
Got quote back this evening and all cost is $4700, a lot less then we imagined.

It's not about insurances - his or yours.

He was in the wrong by hitting you in the rear. It's him you get the repair money from- not his insurance company. Who cares - literally or legally - where he gets the money from. That is his problem.

A solicitors letter with a promised court appearance [plus costs] to him might be the go.

Just got a quote for insurance from them online.
Cheaper than what I'm paying at the moment. About 70% of the price.
"You get what you pay for."
I'll be avoiding anything "Wesfarmers" in future.
Sounds like you got "Bunnings" insurance.

    Everybody does insurance.
Australia Post is trying to sell some.
I think I saw an add for Bunnings Insurance at the Bunnings checkout the other day. It is the Wesfarmers insurance that Coles sell.
They keep taking your money for years. When you make a claim, they cancel your insurance and refund the last premium you paid, as has happened in this case.
That happened to me with another insurance company many years ago but they didn't refund the premium.

Grumbles is right you go the driver its up to him to chase insurance tails round and round give him a letter of demand then after a week or so go to the local court and have him served speeds up the process when the sheriff arrives

We do all our insurances through a broker and hence put a lot of trust in him. We then ask the pertinent questions and read the PDS where necessary. This was particularly important earlier this year when I drove the ute into a tree on a shooting trip.

    image-2704510617.jpg

allianz were absolutely fantastic, had assessed it as written off within days and then called me to negotiate a payout figure. The only stupid thing was I'd gone with market value instead of agreed on a ute with high km but every conceivable option and accessory. Came out good and that's how I got back into land rover ownership.

Was very funny actually... Took the ute to the local smash repairer, their in-house assessor comes out and looks at it for like 3 seconds and goes... "yep it's f###ed", then by the next day, the allianz guy did the same thing and called me that afternoon. Was a really smooth process, and the only hard part was being put on the spot when the allianz assessor called and expected to negotiate a payout figure over the phone, no pre-warning, no nothing... But we did well, got him from his "top value" of $15000 upto our estimated value of $19000 so yeah it was a good outcome.

    Btw... Trees don't bend!

    Hi all
has anyone else noticed the cost of insurance going through the roof.
I rang the insurance company and was told its due to queensland floods, victoria fires, western australian fires, nsw fires and storms. Im already paying tbe flood levy out of my pay every week. Where does it end? At least the price of bananna's is coming down.
And thanks for this forum my night shift goes so much quicker now.
    Cheers
    steve

If the owner of the car has admitted fault, then their insurance company has the obligation to repair your car.

They can't just say that they will deal with your insurance company. Supposed you were driving a 1979 Commiedoor that was worth $500. I might put 3rd party on it, just in case it was my fault, but nothing else.

They have to make good to the damage done to your vehicle. Insured or not.
