Best damned news I've read this year, I made a comment on JJJ's web site that they had put up about boat people. I got some very nasty and violent replys (basically all I said was do any of you who are so anti them know anything about the conditions they came from) 1 reply included a death threat, I lodged a complaint with JJJ nothing happened.

I agree that it's good news. Sometimes people think that the net is all anonymous, and that they can say what the hell they like and get away with it.
You have an opinion, you should be prepared to stand up behind it in a court of law, not hide behind some user name on the net.

This type of thing is always a double edged sword ... there are pro's and cons to such action. I always tend to lean toward more freedom of speech - and while I understand the issue of defamation, there is a censorship quality to all this that doesn't sit so well either. It is akin to kids in the play ground calling each other names ... should we have defamation cases in school too?

We don't have an inalienable right to free speech in Australia, laws of sedition, defamation and slander put limits on free speech.
We also managed to elect a political party based on their leader's promise for no carbon tax and now the tax is on the way, hence we don't live in a democracy but merely a system of elected dictators.
You won't find me on: faceplant; Scipe; Infragam; LumpedIn; ShapCnat or Twitting. I'm just not that interesting.
Australia has no rights of free speech (or much else, for that matter). In fact, proposals to establish a "bill of rights" similar to the American system have been invariably rejected, mainly because Australians cannot agree on what rights we should have.
This case is very similar - we all want our "rights"; as long as someone else's "rights" don't affect these "rights". In this case, we want the right to denounce the "scumbags" of the world, but the right not to be denounced if we behave the same way!
As far as democracy is concerned, Australia's democratic processes, which are certainly not perfect, are an improvement on those of probably 95% of the rest of the world, and unlike "rights", are pretty firmly established by constitution and statute law. If you don't like the current federal government, blame the people who voted for it, not the process. They should know by now that politician's promises are hardly inviolable!
