They have to pay you for the full cost of repair and in fact do not have a right to the wreck of your defender. They will try to claim they do but they don't, don't let them remove your property from your possession. It matters not that you may be able to repair it cheaper than the cost of the quotes.

    You can then negotiate.

    You must have got the other drivers details, send them a letter of demand asking for the cost to repair or replace. It is then up to the other driver to send the letter of demand to their insurance.

    The insurance company could deal with you or ignore you. They can settle, they can fight it in court but will most likely settle if they can negotiate a payout they think is fair. If your insurance company gets involved they will most likely settle.

    I think it might be an unwritten rule, force the the other chum to use his insurance, that way you have to at least pay the excess and it keeps the insurance companies in business.

    im good mate same thing happend to me few years back in a 89 rangie the bloke fell asleep behind the wheel.at 16 months old my arnt ran me over in the bush mum found me walking around with a****ty nappy and tyre mark across my back left with big scare on my guts doctors opened me up. me and cars

    I'm happy to see you can tell the tale and with that last posting of yours you must be keeping the local tattslotto agent wealthy.

    Just a thought, find out the buy back price of that Land Rover, as there would be some on here that would like the chance to get it it for spares, that's assuming it will be written off.
