Yes, manufacturers warranties are now not worth the paper they may be printed on. They are only an agreement between the retailer and the manufacturer, as they have no bearing on the contract between the retailer and the consumer. Makes it difficult for the retailer as they now have one set of conditions imposed by the manufacturer, and another by legislation. Having said that, all the 'examples' in the first article are one side of it, and I can quite easily imagine how these may be genuine responses that have been paraphrased by the consumer to suit their claim with the ACCC.

sadly it is just another nail in the coffin of small family run retail businesses

My 10 month old HP laptop has a noisy fan and the Bluetooth does not work - now looks as if I return it to Tricky Dickies for repair under warranty rather than direct to HP.

I've got a long whinge in the Cantina about back-up following probs. with suspension on our van. Guess what, taking it up with the consumer affair lot has been largely a waste of time with our "liason officer" pleading a heavy work load.
Apparently we must now have the shock absorbers removed and sent to Melbourne to the manufacturers for testing and it's taken 4 months for them to get that far after just denying it.
We haven't used it in that 4 months as we feel they're going to use any excuse they can to blame us.....what's the odds on them saying it's been misused as there's gravel rash on the shockies wich obviously shows abuse? Pity we paid them an extra 3.5K for so a called off road suspension upgrade.
I suspect that they're just going to hang it out until we go away but the retailer is going to provide a new tyre at least.
So much for warranties supposedly enforceable by additional rights under state laws.

We had a problem with a NIKON camera... shrt story is the (Photographic chain of shops...) played funny fellows with the warranty and as to 'where' it had been sent.

By diligent investigation I discovered it had never been sent "East", and a phone call to the local independant service agency expedited matters. Result was camera fixed quickly, photo shop reputation for honesty tarnished... and Nikon helpful and in the clear.

Funny HN should be mentioned... we have a CANON camera returned there under warranty. Estimated time is 2 to 3 weeks... a fortnight ago.

Interesting to see how it goes.

perhaps we should start by sueing consumer affairs first for lack of due representation?

Here in the UK it is normal for the maunfacturer of consumer products to do a deal with the retailer. Called BOG - bought out guarantee- the retailer takes a cut in the price paid and then takes on the warranty responsibility. Customer will know nothing about this. Just deals with retailer while thinking it is the manufacturer.

eg basic canon printer is about $50

small retail such as me buys 5 @ $38 ea and then pays $10 freight to get same to shop via the local courier and has to pay for in 14 day max usually.

those printers have 12 months manufacturer warranty and ****s knows how long a consumer guarantee on something that arrived to them as a sealed boxed product and they had no input into the manufacture.

any small retailer is going to take a hit eventually so they have less than $10 a unit in which to take a profit, pay wages, the light bill and tuck some away for a rainy day..

sending one back on RA to the manufacturer costs more than the original profit.

    manufacturers must be loving it...

    thank you mr samuels ....

and people wonder why small retail is dying...
