    is there more to this than whats stated here?

    Minh Duong was viciously bashed to near death by three neo-nazis. Studying in Melbourne, Minh was punched, stabbed and had a brick broken over his head so hard it broke in two -- now while recovering and visiting his mum in Vietnam, his student visa has been suddenly cancelled.

    Last week, Minh was travelling back to Melbourne for the start of uni when Immigration officials said his visa had been cancelled. Without letting him know, it seems they changed the expiry date of his student visa to a year earlier (it is technically still valid according to the documents) -- meaning Minh was ordered to return to Vietnam immediately or be arrested

    I recall reading recently of another foreign student who was involved in (I think) a motor vehicle accident and spent some time in hospital (in Australia). Obviously while he was in hospital, he was not attending his classes at Uni.

    Some bright officious twerp in the Immigration Department (or whichever government department it is that manages these things) decided that, because he had not been attending classes, he was not in compliance with the conditions of his visa - and cancelled the visa, so the student was ordered to leave the country once he got out of hospital. I believe the decision was being appealed when I read about it - haven't seen what the outcome was.

    It's about time somebody went through some of these government departments like a dose of the ****s and sacked a large number of the useless oxygen thieves that (supposedly) work there.

    ......and I will add that if this is delayed by the "somebody" responsible to to it he/she should be removed as well.

    They only apply the policy and legislation that has been determined by the pollies - if you have interaction with govt departments, you will soon be squealing once Abbots useless oxygen thief redundancies cut in and services are cut further.

    There was also the case last week where an indian student was bashed and is in hospital - pre-empting the cancellation of his visa they have appealed to Morrision but as usual he was non committal on the specific case but did say the government does not do such things.

    Now that you mention it - I think it was this case involving the Indian student that I was thinking about - certainly rings a bell. I couldn't remember the details of what put him in hospital, but now that you mention it ..............

    I agree that the public servants only apply the policies of the government of the day, but I've seen so many examples where you would have to question just "how" they apply these policies. Too often there seems to be an attitude of "shoot first and ask questions later". The case of the Indian student that you mention is a classic example. I'm sure that if the public servant involved actually did a little bit of work and gathered all the relevant facts and presented these to his / her superiors, the outcome would have different.

    Seeing as you named Govt's ( I wouldn't want Chucka to acuse me of introducing politics, so you better be careful as being the consistent person that he is, he will certainly dress you down) it should be pointed out that it was the Gillard Govt who changed the student visa legislation wiping out a 14 billion($) industry over night and changing the stay requirements.

    Personally I though it was a terrible decision as we actually employed 6-7 students who needed to work to survive and they were xcellent workers. We were able to accomodate them sharing a position and rotating their days on as their study requirements changed each semester.

    Morrison also recently overturned a previous Govt decision to not allow a woman into the country for what Ibeleve was live saving surgery.

    In fairness, I doubt most of the departments don't talk to one another [ as in exchange information] There is probably not enough money in the kitty for the relevant dept. to investigate , so they just tick & flick....some one else's problem. Bob

The terms of their visa require them to attend classes, maintain enrolment, and make satisfactory progress towards completion of the course. Stop attending, fail, drop out, and the visa holder is no longer considered a student.

    The attendance records and such are probably held on a computer which is then hacked by the yanks, problem noted and info delivered to the approriate Australian department by an Obama under secretary.
    No effort required on our behalf, boxes ticked.
