I can understand this. It cost a reasonable amout of cash to do your "P" test. When I was 17 I didn't have much cash. I think at the time it was a weeks wages to do the test as a first year apprentice.
I passed first go on my Birthday but I'd done thousands of Km on my "L"s. I was a office machine technician appentice sevicing the central west (NSW). The techs who I worked with go to sleep as we left town and I would wake them up at the first job. 80km/h can be pretty boring when you drive that much.

I wasn't saying it's expensive but I think it's fair to be anoyed for a fail. I doubt it was JUST for going a km/h over the limit but I still understand the frustration.

The speedo cannot by law read less than the actual speed and usually reads several km/h, or up to 10%, above the actual speed, as others have said. For example, my GPS shows that when the D1 is doing 100km/h in top auto the actual GPS vehicle speed is 96 km/h.
So, if the speedo said 41 km/h the actual vehicle speed was probably about 37-38 km/h. Therefore, the vehicle was not speeding.
This speedo thing is a reason why speed cameras are set with a margin of several km/h before they go off, I understand.
Of course, as others have said, there were probably other reasons for failing the learner.
It would make an interesting argument if the person wanted to take it on that they were not actually speeding because the speedo was wrong. If that was the case I guess they'd be happy just to have the money for that test refunded and another go at the test. Problem is it would cost more to prove the speedo was actually reading higher than the road speed was/is.

When I went for my bike license back in '87 (or thereabouts) I was failed on my first test. Teh instructor said "I never pass anyone first time". Yep he actually said so. That is, in my opinion, corrupt. What a *****. Anyway I asked what I'd done wrong - he just ticked 6 or 7 boxes at random on the sheet and said "whatever I like".
That's a straw man argument ! And meaningless.
Just because it's more expensive somewhere else, doesn't mean we aren't being shafted !
When you meet a paraplegic do you say "Well, at least you aren't a quad..." ?
