Put simply, No, you should get a higher rate to compensate for the lack of holiday pay etc..
You disserve a medal oops no I didn't mean that.
I think the recent debate on penalties misses some of the issues.
Emergency service workers are to be exempt from the loss of penalty rates, however what's missing in the debate is what the penalties are in health.
The penalty on top of the base rate is:
- Afternoon shift (shift starting at 10am and before 1pm) is 10%
- Evening shift (shift starting after 1pm and before 4pm) is 12.5%
- night shift (shift starting after 4pm and before 4am) is 15%
- Saturday shift (hours worked starting from 00.00:01 Saturday morning to 12:00 Saturday night) is 50%
- Sunday shift (hours worked starting from 00.00.01 Sunday morning to 12:00 Sunday night) is 75%
Only on overtime does a double time (200%) rate exist but only after 2 hours at time and a half and triple time doesn't exist.
So if people in other industries want to keep penalties then the ones where double time and triple time exist, then they may have to compromise and fall back to the same rates as health etc.
