    whats going on

    Hi all as I sit at my table having breakfast in the paper a motorist has been shoot and killed in Sydney from what I read he may have been an innocent passer-by. So what is going on an innocent person dies the low life will at some stage most likely get court by the police go to court give some bleeding heart story and our soft touch system will feel sorry for him. We seem to be following America with drive by shootings we need to catch up with there justice system where people like this do life for there crimes. If nothing else it would give the police the satisfaction that there is at least some gratitude for the job they do by the courts.

    A year or two ago, also in Sydney, a truck driver was killed by a stray bullet from a gang gunfight outside a fast food place.

    These sort of occurrences are pretty rare in Australia, and tend to have a lot of police effort put into the, usually successfully. Probably because the underworld usually feels the pressure of police and someone drops a word in the right place to try and get the pressure eased off.

    There hardly seems a night goes by when there is not a bashing, gang violence or a shooting in Dodge City.... oops, I mean Sydney.

    .....and...unless punishment fits the crime......it is going to continue unabated.

    Perhaps tell the magistrates to stop giving suspended sentences and the like, and perhaps we'll see some improvements

    NSW has a prison accommodation crisis at present. This is despite the fact that most categories of crime are at the lowest levels per head recorded since records started. Problem is that the population has increased, as has the length of sentences for many crimes, plus some crimes are attracting custodial sentences that have not in the past.

    About the only crimes that have increased in recent years are those where what has increased is almost certainly reporting not the frequency of crime itself, such as domestic violence and some sex crimes. What has increased is communications.

    We do a bit of contract work at a Youth centre.

    The kids got on the roof,smashed a heap of AC units,vent fans,etc,total of around 20k of damage.

    And the punishment was……... a talking to.

    This has happened before,just a joke.

    A few years ago they used to get the fire hose and hose them off,but apparently now you can't do that

    The whole legal system needs to be sorted out,but no one has the balls to do it

    It appears softly, softly is the way, and it isn't going to change anytime soon

    How many times have we seen prisoners, Illegal Immigrants in Detention etc etc, up on roofs doing damage etc, on the rampage etc etc,......and all we do is,.......PLEAD, for them to come down.
    Me?...I'd be simply leaving them up there, surrounded by armed guards on the ground, and simply tell 'em to stay up there until they're ready to come down,...no food no water etc,..leave 'em up there till they're ready to come down,....then lock 'em up in solitary for a few of weeks, with no "privileges".

    Well , I wonder if it's the role of the Supreme Court to rule over the individual Magistrates and Judges conduct.

    Who decides what final judgement can be delivered?

    Is it the way the laws are written that allow defense counsels to win cases or award pathetic punishments for these criminals.

    Something needs a ****ing good shakeup in the system.

    Who can do this?

    We (good people) are all screaming out for something to be done.

    Perhaps worth remembering that one of the usually unspoken legal principles is the one usually described by a phrase such as "better that ten guilty go free than one innocent be convicted".

    Rules of evidence and legal procedures have been adopted in the light of experience in the administration of justice over hundreds of years. We need to be very careful in proposing changes to these based on media reports of their shortcomings.
