    As a general rule individuals can be held liable if they owe a duty of care to another person and breach that duty. There can be odd applications of vicarious liability though. Take the case of a teacher sexually abusing a child in the care of a school. In some circumstances (certainly not all) the school can be held vicariously liable for the tort committed by the teacher... Cheers

    Trout, there are probably hundreds of roads in Qld that are not maintained, with some not even formed, although surveyed.
    There's a road not far from me, Laceys Creek Rd, which a lot of members would know, that is unmaintained and suitable for mtn bike,horse and foot sloggers only.
    The only way the OTT is not a road now would be if an application for a road closure had been lodged and granted, which is not reflected by the current Qld cadastre.

    In Queensland at least, below all power lines is a gazetted road by default.
    If you don't like trucks, stop buying stuff.

    The problem with the mining "boom" is that there are too many complete cockheads find their way into senior management roles due purely to not enough suitably experienced and qualified candidates to fill the number of positions available.

    It is classed (by the relevant Council) as a 4wd Adventure Track, not a road. Why should the residents of the Cook Shire, pay to maintain a piece of road for the enjoyment of a few people, many of whom will not spend any more money within the Shire than they absolutely have to. Listen to the talk around the camps of an evening, and you'll hear lots of people boasting about carrying jerry cans of fuel and multiple cartons of beer from Cairns, just to avoid paying local prices on the way through.
    There is a whole lot of money being spent on the PDR - eventually it will be bitumen all the way to the tip. If you don't like driving on unmaintained roads, then just wait a few years, and you'll be able to "do" Cape York in a Prius!

    While I’m sure some bypass spending up there, I bet there’s a whole lot more that do. Would be interesting to see what the town said if all tourist spending was suddenly cut off - I think they would notice, but I do get your point. Funding should come from the State Government for this.

    Gazetted Roads refers to roads declared as such and published in the State Govt Gazette (in Qld that was a governmenty magazine a little bigger but thinner than a Readers Digest). They have been online for a long time now.
