I sold a vehicle (in Vic) without a RWC. I got the purchaser to sign a document saying so. I also gave him the applicable VicRoads form. I took off the number plates.
A month later VicRoads sent me a letter saying “you sold a car with a RWC but failed to provide it”
I scanned the paperwork, sent it back to VicRoads and never heard another thing.
The guy said he was a mechanic - so I am guessing that he was just trying to pull a swiftly... *****...

The Victorian rego papers used to have the disposal & acquisition forms on the back but that has not been the case now for a long time- I think it would be 15+ years. The forms now have to be downloaded from the interweb. A vehicle has to be either sold with a roadworthiness certificate (RWC) or the plates have to be removed. It used to be common to fill in the forms as 'sold with RWC' and let the buyer take the vehicle with the plates, then arrange the RWC and send it in, as that is less hassle for the buyer than re-registering the vehicle from scratch (if the plates are removed, no paperwork other than a receipt of sale goes with the vehicle). I have bought & sold dozens of vehicles that way over the years. But then it also used to be common for people to do what they said they would do. Less common now it seems.
Addressing the statement "I thought in all states there is a section on the registration document that when you sell the vehicle you fill it out and rip that section off and send it into registration authorities and you give the rest of the rego document to the buyer.".
Seems to be quite a few stories that don't make dealerships look too good.
We had friends out for a year from Switzerland who bought a secondhand VW Transporter from a major dealership. After they returned home we were left with the vehicle to sell for them with all paperwork pre-filled in. Whilst we had the vehicle we started getting letters from a tolling company as our address was down with TMR while we were handling the sale. At first I assumed our Swiss friends had just peen pinged without an e-tag as many overseas visitors are. Instead we found that there were hundreds of dollars of unpaid tolls against the vehicle's number plate from when it was still with the dealership, prior to them even buying it!
Sent the purchase receipt & rego details to the tolling company and never heard any more. The sale was quick and no drama with registration properly and definitely transferred but I wonder if the new owners got any more follow up correspondence? And surely eventually the car dealership has to be called to account.
