I sold a vehicle (in Vic) without a RWC. I got the purchaser to sign a document saying so. I also gave him the applicable VicRoads form. I took off the number plates.

A month later VicRoads sent me a letter saying “you sold a car with a RWC but failed to provide it”

I scanned the paperwork, sent it back to VicRoads and never heard another thing.

The guy said he was a mechanic - so I am guessing that he was just trying to pull a swiftly... *****...

Looking at the back of my rego document it says:

"NOTICE OF DISPOSAL

Complete this form and email to .......... or Post to .......... (Registration Authority) when the vehicle is sold. Do not give to the Acquirer. If you do not provide all information, we may not be able to process this notice and you will remain responsible for the vehicle including any infringement notices received"


So is this not also the case in Victoria - seems to me the seller just handed over the entire rego document rather than removing the seller section and sending it in.

The Victorian rego papers used to have the disposal & acquisition forms on the back but that has not been the case now for a long time- I think it would be 15+ years. The forms now have to be downloaded from the interweb. A vehicle has to be either sold with a roadworthiness certificate (RWC) or the plates have to be removed. It used to be common to fill in the forms as 'sold with RWC' and let the buyer take the vehicle with the plates, then arrange the RWC and send it in, as that is less hassle for the buyer than re-registering the vehicle from scratch (if the plates are removed, no paperwork other than a receipt of sale goes with the vehicle). I have bought & sold dozens of vehicles that way over the years. But then it also used to be common for people to do what they said they would do. Less common now it seems.
