The best you can do is reply in writing (mail it to be sure) using words to the effect that the item was sold in working condition, and in good faith. Whilst you don't doubt the genuinness of the purchaser, you have no way of confirming how the unit has been treated for the past 11 weeks and therefore cannot offer any form of refund or recompense. The item was sold with no warranty, implied or otherwise, and is (unfortunately) now the sole responsibility of the purchaser. I would make sure you use plenty of sympathetic, comiserating language to help soften the blow - maybe recount a similar situation you might have experienced. Bottom line is, keep it light and friendly but tell it like it is.
This will be dissappointing and no doubt annoying to the bloke, but there is nothing else you can do. If there is any bad Karma as result of this, then just be on your guard.

No one can feel guilty of "Acts of God" or the "***** Happens Factor". I also feel un-easy selling anything second had, but and the end of the day how long can you give warrantee on anything???????

Well i know someone who sold a car and it was in perfect nick and it blew its head gasket the mechanic put it down to it being a manufacture fault but i dont know if that is the case here

As has been said before caveat emptor, everyone knows that when they buy on "the bay" from a private vendor there is no guarantee.
How do you know that it is not the electrical system on the buyers car buggering it up or the 3000 Km of corrugggggggatted roooaaaddd that did the damage. If he wanted a warranty he should have bought new from a reputable store and not one in cyberspace.

The Sale of Goods Act provides that the goods shall be of "merchantable quality", That is, fit for the purpose for which they are sold. In the case of used goods that were sold in working condition, as is, where is, then that meets the requirements of the Act. However, if the goods are found not to be as described, or have been made to appear fit for use, but were indeed faulty, then there is cause for action and possibly recompense. If you ever have a yike with a used car dealer, then it is preferable to proceed against them under the Sale of Goods Act, rather than the Motor Dealers Act which really only gives a slap on the wrist.Originally Posted by DirtyDawg

Well, thanks everyone for your encouraging help... and I mean that. I'm always looking out for the other bloke because that's the way I was bought up.
I'm going to have a chat with the repair agent and see what his side of the story is, and if it's genuinely stoofed, I'll consider my options then. I hate, as I've said, to leave someone in the lurch, but I guess that it's just plain bad luck, unfortunately.

That's why I don't like to sell to people I know - I'd feel guilty if the item failed.
