so what's actually free in a free trade agreement?
Just got done with some info chasing RE: importing bulk items ala this thread http://www.aulro.com/afvb/shopping-t...rue-track.html
the basic nuts and bolts of it As Ive just had it explained to me is thusly.
1. if you import over the threshold (which varies from goods to goods) you pay import duty
2. If you import bulk goods (for yourself) that individually dont go over but the bulk order does you get up to the threshold duty free then you pay duty on the rest
3. If your importing bulk goods for dispatch elsewhere so long as you are not onselling the goods then you dont pay for the import duty, that is the responsability of either the recipient if the goods are going direct or the person in australia who then sells the goods onto the final buyer.
for the last point which seems to be where the grey area of the law is.
If I was buying all the diffs from the thread and then selling them onto the individuals I have to pay the duty
If I was simply picking up all the orders and then transporting them to the people who paid for them I dont pay the import duty that is the responsability of the people who bought them... so lets say I have a shrunk wrapped pallet with 10 diffs on it 5 of which dont need duty paid on them 5 of which do all of which are in individual boxes addressed to 10 different people all with correct reciepts of purchase but not duty payments and customs traps and opens the main pallet and checks the load out. In the event of something like this happening they have the ability to hold the entire consignment (not just the diffs that need payments) untill all of the duties have been paid.
What becomes grey is who is actually repsonable for payment of the duty in that case. the spirit of the law is that the recipient of the diff not the carrier is the one who pays the duty but the letter of the law is interpretable as the carrier can pay the duty to have the items released. and we all know what happens to law when laywers get involved and there is a discrepency between the spirit and the wording (and god help you if there a typo or a miss placed punctuation mark.)
Thats from the mob at work who deal with quarrentine and customs on the RAAF base. Its only a general guideline as to how its intended to work not whats actually likely to happen as as with all things legal theres ways and means of justification around those laws should you do something to **** off the inspector. (naturally thats not the only reason that it would happen but its my favorite as I use it quite a bit when i get a narky guy trying to tell me how to do my job when it comes to repairing inspecting and releasing his vehicles)

The AUSFTA varies a bit in accordance to the percentage of local manufacture or materials, ie if the raw casting is done in mexico but machined in the US than you can claim the AUSFTA as the item has gone thru a change of customs tarrif classification. Also there are some exclusions like textiles and apparel which doesnt get duty free status but a reduction in the duty rate.

Scenario 1
Each person ordering the goods directly from Keith and the total amount of the order is not greater that A$ 1000.oo including freight.
Is tax applicable in this case ?
Does it make any difference if it is more than one good in the order ej. diff and axles?
Scenario 2
David orders and processes all the orders, but they are delivered to each purchaser from directly from USA. Are the goods tax exempt ?
Scenario 3
David processes all the orders which are delivered to a single address but in the name of the purchaser and paid by the purchaser.
Are this goods tax exempt ?
