    slight bingle today

    Hi Folks,
had a slight rear ender today, nothing major, dumb female in front who did not indicate left then decided to turn left then decided to suddenly stop for no reason whatsoever except and quote "I was not sure where i was going" No **** sherlock . Not even a car in front of her. Anyway 3 ton of Disco went up her bum.

Her rear end was banged in a bit, we ended up with a broken spottie and the under bumper plastic guard that covers to tow hook popped off and needs new catches.

My question ieven though this is minor prang is there anything in the front end that needs to be checked over by LR? It needs to go back into them soon to have the brake booster repaired under warranty.

    thanks
    cheers
    Peter

have them eyeball the crush points on the front of the chassis, the mounts of the steering gear and the point where the naffy steering protector hooks up.

if all thats good then your apples, if anything there is off spec then have them also check out the front suspension mounts for cracks and bush elongation.

    I had to smile.

You rear ended someone else (making it YOUR fault) and then you tried to blame it on her!

I am not having a go, it is a perfectly normal human thing to do.

Just because he rear ended her, doesn't make it his fault.

There was a program shown on the BBC a while back that exposed a group of people who delibrately tried to get rear ended so they could claim personal injury etc.

Do the police in Aus automatically treat such accidents as the fault of the guy behind?

    Yeah it does.

Failing to follow at a safe distance, I think is what they will get you with, along with driving without due care.

Very similar to my rear-ender the other week. Yes, technically it is the car behind's fault in any rear-end collision for failing to observe... follow too closely... or whatever reason...but...

if the Police attend and it is proven that the car in front did something stupid - failed to indicate, did not drive with due care and caution or something, then they will get fined and you have a argument for it being regarded as not your fault. But the police have to attend and then you risk being fined too.

...but it is easier to just cop it and move on. That's why this place exists, so you can vent your spleen and have some sympathy.

My summary assessment of this kind of thing - the other driver caused the accident (if they didn't do something unpredictable it would not have happened) but it is still your fault (you are expected to be prepared for the driver in front to do something unpredictable). It's a bummer though.

Further to my post above, I had a situation a few years back where a driver cut in front of me from the right hand lane and jammed on the brakes before making a left hand turn. I must have missed them by a poofteenth of an inch, the ABS saved me for sure. No indication, they either didn't see me (in a Defender) or were just that stupid and ignorant they didn't have any sense of just how close they came to being roadkill.

What would be people's assessment of that scenario? I know if I had cleaned them up I would NOT have accepted responsibility and called the cops if necessary to get it on paper that I took appropriate evasive action to avoid a collision with someone who was just not driving properly. Just because you hit someone from behind does not make you at fault if the other party deliberately, or carelessly put their vehicle in front of yours without warning.

lets get the facts straight shall we?

She did not indicate, then pulled left at last moment, I veered left well away from her, she then pulled left in front again with no indicator and stopped dead for no reason as there was no traffic in front.

That is my fault? Get real
