    I agree with the general consensus. - Get it in your name first. Be sure to retain the bottom half of the RWC when you change it over.

    1. I would give the seller the chance to make it good.

    2. If you have no luck there I would try the RWC issuer. Although they are not legally liable to fix it most will so they don't loose their licence.

    3. Give Vicroads a call and see what they have to say. They will be more than interested in a dodgy RWC being written.

    As on the other thread, I think that you will open a world of pain if you start to fight the RWC issuer. Below is what would happen in NSW.

    First I would expect the government to then inspect he car themselves , and they will go over it as RWC agents are supposed to and find numerous faiults which will then need to be fixed. It will then have to be reinspected after being totally fixed before a RWC is issued.

    An unregistered car in NSW is worth hundreds less as they have to have a "blue" slip rather than a "pink" slip, which denotes a much more rigorous inspection probably by a competent workshop or by an RTA inspector.

    The RWC issuer will say, "it was OK when I inspected it" . And it will become a "he said She said" , as there is little proof . If the car has numerous faults then the guy may lose his licence, which may give you satisfaction but no monetary help.

    The seller will say " I am not an expert and that light has never come on, and I didn't know it had to" . How do you disprove it?

    I believe that you end up in a world of hurt if you go what seems the "right" way.

    Sorry to hear about the problems you're having.

    The rules on this one are clear and simple. If (in Victoria) you buy a car from a private seller, you have no warranty, no gaurentee, no right to return the car. Nothing.
    The onus is completely on the purchaser.
    This is one of the reasons I would never buy a car privately unless I knew it was an old banger that needed work, or it was a newish car with balance of manufacturer warranty, complete service history and a mechanical check by the manufacturer.

    The best you can do is contact the seller, highlighting the issues with the car and hope that he is willing to help amend the problems. I've hardly ever seen this happen.

    As far as the RWC goes, the workshop that did this is responsible for making sure all bulbs/warning/safety features work. This clearly falls in line with SRS and seatbelts. The only issue you might find here is proving that these items were faulty at the time of RWC inspection.
    Contacting the VACC about the person who issued the RWC may help your cause, or even threatening to contact the VACC usually helps. I pulled this card when contacting a car dealer about issues with my car after purchase.

    At a pinch you can try the small claims tribunal, but that might be a more longwinded and expensive process than righting the car yourself.

    Thank you everyone for your support, encouragement and very kind words

    I am off to the doctors now, and Vicroads is another 10 minute drive past there, so will put the car in my name this morning.

    I will talk to the seller and tell him what I think of his dodgy deal, and try to convince him he has to help pay for some of the work which needs doing. I will try to include an implied threat that things could go legal if he does not oblige. Probably won't get me far though.

    In the mean time, my new project(!) is still running and getting me from place to place, and I have plenty of time to spend working on it, taking a little from each months pay packet to cover costs. Not what I had in mind when I baught her, but I will enjoy learning more about mechanics so it is not all bad.

    Thanks again people, at least I found this forum! So I haven't totally messed up after all lol!
