You have to do the latter (stud torque to 10, nut to 40). Otherwise you will strip the threads. This may happen anyway, but far less likely.
I just put my exhaust manifold back on and put all the studs back in, all of my studs have the nut seized on them and came off like this, so i am wondering if it is okay to tighten to the 40nm as is or do i have to take the studs out undo the nuts of them, tighten the studs in at 10nm and then the nuts on at 40nm?

My worry is ill have to remove the manifold completely to do the studs up, which seemed pretty difficult with seized bolts on the exhaust.

You don't need to remove the manifold completely - just the manifold bolts so that you can move it out of the way and get the stud in.
