I pressume that air pressure allowed through the moderater activates the waste gate and so there is no turbo pressure resulting in reduced power out put. Hope I have got it right and a new part will solve this problem.
I think you're right re the modulator being faulty.
The default operation (without the ecu supplying an earth path for the modulator) only the ports for the turbo outlet and the wastegate actuator should be open. This provides the default wastegate opening pressure. When the modulator is progressively operated by the ecu, some turbo inlet vacuum is applied to prevent the full boost pressure from getting to the actuator thus providing controlled over-boost. Yet you have all 3 ports open without ecu intervention which will allow excessive over-boost and thus the ecu will cut fuel to limit the boost.
