oil leak in fly housing (300tdi)

hi guys need some help and advice

i had a bottom end go in a 30tdi, so i had it swapped for a second handy while they where at it i got them to put a heavy duty clutch in. also had a new rear main seal and gasket.........so not even 6 weeks later i took it to the mechanics for a rwc. and was pointed out to me that it had a leak (he thought rear main), I had noticed it but not thought twice. and then realized that yes there was a lot of black stuff coming out, especially where the bell-housing and flywheel housing meet. so after pulling off the box, clutch and flywheel, I can see that it is definitely not rear main but there is substantial oil below, and i have an oil ridden clutch plate (makes sense now as it has gradually been loosing grip, but I hadn't really noticed).
when i contacted him he said "i can look at it but if it isn't a rear main ill charge"(bit of paraphrasing) so hence why i have pulled it apart and i have done the work so far and wanting to find the problem but i need to know where i stand

what i want to know is.
The guy who installed my engine. should he have replaced this seal too when it was out?

And what is my next step as i have paid for a job to be done 6 weeks ago. and i feel that it was not done satisfactorily (i understand about second hand parts but it isn't a part it is a seal) and i now have a clutch plate which isn't worth spitting at.

The 300 is reliant on both the rear main oil seal & the T seals in the no. 5 big end to keep the black stuff towards the front.

The rear mains are notorious at being done badly... as are the T seals!

Having said all that until you get the mechanic who did the work to admit he did it dodgy well your no-where and may as well change it out yourself IMO

In order (sort of) : ( Edit: And as Mr RR said ...)

    - the first oil leak you mentioned is more probably the t-seals on #5 main bearing. and/or

    - if not done correctly, the 300tdi rear main oil seal housing and gasket can warp and leak.

Solutions now the engine is apart:

1, Do the t-seals. (See this thread - Method for 300TDI bearing cap t piece install )

    2. Buy another rear main seal - and read up on the correct Landrover way of installation. If done incorrectly, it leaks.

    3. As a tip ( It's working for my 300tdi), leave out the gasket and use a good silicone ( Dow Corning 732 from CBC bearings is my favorite)

As to the mechanic - hard to say. At least you're not the first to have a leaky rear main.

Might be wise to fit a new seal in the front of the gearbox as well, brake cleaning fluid will clean your clutch friction plate if you don't want to buy a new one, Regards Frank.
