The problem is that if people don't see what is being imposed as fair and reasonable then they behave as has been seen in Victoria recently and the spread increases. Why not shut the border with Victoria to all traffic, including trucks, I'd wager there's more risk from drivers having dinner than there is from residents returning home and self isolating.

IF a referendum was called by the WA Government asking to keep the borders closed as they are now until this pandemic has been brought under control they would most certainly get a resounding YES vote which would "Trump" anything that the high court would come up with
The Federal government is backing Palmer in this in an effort to try and "Bully" WA to open its borders against the will of the WA Government AND the people that live here which is Wrong on so many levels.

    No, it wouldn't.

Palmer's challenge presumably alleges that by closing its borders WA hasn't complied with the Federal Constitution, and because WA residents can't unilaterally change the Federal Constitution their views on the matter wouldn't change anything.

Maybe Not But IF the referendum was to happen then the borders would remain closed while the WA Government dragged the issue out in court for a while and by that time hopefully we will have an antidote available anyway

I don't think that the High Court would permit foot-dragging. Also keep in mind that government lawyers are required to be model litigants, and I'd expect that applied to WA's lawyers too.

This is a Perfect example of someone trying to use a loophole in an effort to circumvent the lockdown rules.

Tradie fined for driving to get butter chicken will contest penalty
