    My point exactly. I also suffered a nasty rear-ender from a ute in the Alfa (1970 1750 GTV) and the repair bill for that was over $10K. Never any question of writing it off there either. Now fully restored the car is valued at about $20K with my insurer, but being a very old car and not perfect at the time if there was ever a chance the other insurance companly would try to value it down, that would have been it.

    Once again, you have no agreement with the other insurance company so you are not bound by their terms and conditions. You make your demand then see what they offer you - I would recommend getting quotes ASAP from their preferred repairers (at least two). Even if they were to just declare your vehicle a write off, they can only give you the cash but you would keep the vehicle. There is nothing that says they have any right to take it - they are not your insurer. If you disagree with the value of what they offer then I'm not sure what but there is an ombudsman.

    IME this only works if you dont go through your own insurance company to get the repairs done first but its correct.

    If your insurance company isnt involved then another persons insurance company cant write off your vehicle as beyond economical repair BUT their repair agencies can if the vehicle has had enough damage that it cant be made safe again (crushed crumple zones/fractured primary chassis members for example)

    Is that beach a gazetted road?, I hope so!. If you end up going to a panel beater for a quote, tell him you want a perfect job done on the County and the other parties insurance will pay.......then expect to make a deal, with you keeping the County, and decent cash to fix it!.

    Well i found out a few days ago that on thursday night my mate drew took his own life. so unlike him its insane. all his friends and family are so shocked because he was always the guy with the smile on his face and the loudest laugh. his parents are going to help me sort out my car but i don't even want to think about it yet.

    its incredible how quickly things can change. drew and me were laughing about this wednesday afternoon making up stories about how he crashed. he has been one of my closest mates for the last 5 years and i lived with him for 2 of them. i'm really glad that we got to spend the weekend camping, however i don't think cooloola will ever be the same for me again.

    this is a picture of him from sunday giving me the thumbs up just after he drove his car onto the tow truck.

    condolences on loosing a friend. If its any help while im not much stick with ally I'll offer up helping to sort out the chassis damage for you along with any work needed to square up the tail end running gear.

    My thoughts are with you, his family and the rest of his friends. It's a hard time ahead, and I'll be thinking of you all.

    When all is said and done, if I lose mine (I'm in a similar situation right now); and it gets wrecked, I'll have bits n pieces to spare...might be able to help you out.

    It's funny that often it is those with the smile and the loudest laugh are the ones who are struggling the most.

    Sorry for your loss. A best friend is one of the hardest things to lose.
