    10kmh from a standing start at lights - the person driving without dur care or dilligence is the one in front who fails to indicate twice then stops dead for no reason. I even moved left away from her and the moron then moved left in front stopped.

    My summary assessment of this kind of thing - the other driver caused the accident (if they didn't do something unpredictable it would not have happened) but it is still your fault (you are expected to be prepared for the driver in front to do something unpredictable). It's a bummer though.
    bit like trying to predict a woman's moods and staying on the right side of her, no matter what you do it is your fault.

    Sums it up really.

    Technically and legally you are assumed to be in the wrong unless you can prove otherwise.

    Morally you were not in the wrong but it won't help getting them to pay up.
    Are they claiming for damage to theirs?

    have not reecieved anything to date however my insurer feels she may have a case to answer so will wait and see.

    Still a bit touchy about it mate? I am not having a go and I can't get the facts straight unless I can see the piece of road and the positioning of the cars. I was just commenting on your first post, clearly I wasn't there.

    If she changed lanes in front of you then stopped, fair enough some (maybe all) blame can be placed squarely on her.

    If it was a single lane road, then the car behind is almost always in the wrong, despite how stupidly the car in front may have been driven.

    See how the insurance companies and police sort it out, then it will be decided who was at fault.
