My TD5 D2 has the same cold problem. The dealer experienced it, but the the LR rep drove the vehicle when hot and said there's nothing wrong. Its now out of warranty - not impressed.

Go back to the dealer. You reported the problem while inside the warranty period so something should be recorded, especially if the LR rep also drove your Disco.
The fact that they couldn't reproduce the fault shouldn't affect the fact that you could notice it enough to report it.

Can you leave the car at the dealer overnight so they can experience the problem ?
Then they can raise the issue with LR & have the repair authorised.

How far out of warranty is your Disco now ?

I agree. If the car isn't far out of warranty they should look after you. The only downside is the clutch is a bit of a wear and tear thing so it may depend a bit
