Years ago I was stopped at a on road side roadworthy check here in Vic . I had 2 driving lights mounted on the front of a ute I was driving. They were connected to the hi beam switch only.
I was told by the officers that the lights had to be positioned closer to the main headlights

and in line with them, and a switch needed to be wired in to disable the driving lights from the normal High beam.
The reason you were told about the switch to disable the driving lights, is that you can use the high beam in a built up area, but it is illegal to use driving lights in a built up area, in Victoria.
Lights above the bullbar are illegal if they obstruct your vision, you must be able to see the road 20metres in front of the vehicle from the normal driving position.
