    The application of the term to a justice system would imply that the end point would be that those who suffered from (or were outraged by) crimes would deal with it - as you say - lynch law. And history has shown that in the absence of a justice system, that is what happens. It also shows that lynch law gets it wrong at least as often as does the current system, if not more often.

    I am not sure that the Salem witch hunts were "lynch law", as the trials and executions were carried out by law officers in accordance with established laws. What was ignored was the need for evidence and/or taking notice of evidence. Not the same thing as lynch law. And of course, there is the whole question as to whether witchcraft should even rate a mention in the criminal law. But I am certain that in a few hundred years there will be quite a few things that we criminalise that will be seen in the same light!

    I've been waiting for that one to come up; conversely, if you have the temerity to embarrass the government, you'll do thirty years. Neither Brendan Abbott nor The Great Train Robbers killed anyone.

    Yes, I read about this one. On the original news article that I read it said Rape and inappropriate touching in the same article. Not forgiving what he did by any means as it is still disgusting, but is "inappropriate toching" at the lower end of these sorts of offences or is it just bad reporting by the news site? (iirc ABC online news).

    I would also make the point that child molesters cannot very easily, if at all, be rehabilitated. I gather that it is like being an alcoholic - a disease, in this case a mental one.

    Ah yes, but that involved money didn't it.
    IMO money/ financial related crimes receive harder sentencing than crimes with a human cost.
    Whether that's because human costs are difficult in legalese to determine I don't know.

    Well, there's a young man in Melbourne whose recently passed away as a result of a cowardly punch, in a Pub brawl. The perpetrator has been charged with murder, which I doubt they'll "get" him on, but it will be interesting to see what He does "Get".
