    As for telling you about the criminal justice system Trout, this is a forum. It invites differences of opinion. If I see something opinionated posted that I don't agree with I will post my view. Which you also are doing. The fact remains that most people who criticise sentencing, living conditions of prisons, parole etc have an outsiders view and are not aware of sufficient facts to have an informed opinion. There are obviously exceptions.

    There is certainly a lot more to it than the sensationalist commentators want to admit.
    Remember that Australia became a convict settlement because the British criminal system imposed such ridiculously extreme sentences - transportation for stealing a sandwich because you are hungry for example. That extreme system failed and was humanised.
    Also ask why people commit serious crimes. There are many reasons, often related to family conflict and breakdown.
    For example I know a 10 year old boy who will be lucky to avoid prison by 20. His family life was so bad because of the behaviour of his parents that they have been forbidden by a court from ever having contact with their children again. So that's a magistrate being tough.
    This kid is now boiling with anger, has been rejected by foster parents because of his bad behavior and dumped in a group home, where he is running wild. Cuts to support funding mean he is not getting the mentoring needed if he is to ever get his life on track.
    How would throwing this kid in juvenile detention help him? It probably won't.
    So, my point is, those who say 'lock them all up' should take a look in the mirror of society and ask what went wrong in society to cause them to end up that way.
    Kids aren't born criminals - they are made that way. Unfortunately, many families are failing, half of marriages are breaking up, kids are being harmed and these are the results.
    Cutting family support services to chase votes is making it worse because it becomes more likely that more people will go off the rails, commit crimes and end up in prison.

    There are thousands if not millions of people come from disfucutunal famillies and yet the vast majority of these people don't end up with criminal behaviour problems.
    I and I am definately not alone in saying that i am sick and tired of this sort of excuse being used to justify criminal acts along with trying to justify criminal acts on drugs and alchahol use.
    If people do the crime they do the time, No If's or But's about it.
    You only get one shot at life, Aim well

    I didn't justify criminal behavior, but I did say we should try to understand it's causes, otherwise we as a society just keep repeating the same mistakes. None of us is an island, we all function within a society, so we all have a role to play. If every person mentored one troubled person to improve their life, this would be a much better society, instead of going backwards, as we currently are. Actually, it surprises me that there aren't even more crimes being committed, considering how the privileged are trying so hard to steal from the rest of us, as the banking royal commission shows. Everything is connected to everything.

    Lots of people have had very hard upbringings and gone on to be very successful and decent people it's a cop out if you know how bad it feels by there upbringing why make others feel that way. Its a choice that they have made bad choices have bad outcomes.

    Yep nice and easy hey. It's so simple. I don't know why very experienced people with broad experience bother. Don't take into account upbringing, mental health issues etc just bin them in poor conditions and throw away the key. Easy. Seems to work in the US...

    Here's a thought, on the "do crime, do time" basis drug dealers aren't actually crims, as they are not forcing pills down people's throats, needles into arms, etc. the junkies come to them, basically a victimless crime, or perhaps the victim doesn't know they are one. They are not even guilty of the crime of depriving the govt of tax revenue, as there is no alternative competing legal stream.

    Hi,
    It is a problem that doesn't fit the legal system very well I think.
    Victimless crimes?
    Hmmm, is that similar to selling a product that harms the end user?
    I'm not sure the ' lock ' m up and throw away the key' solution is viable now we have no more colonies to send them to work at.
    It is a Department of Corrective Services after all. Surely turning out a rehabilitated person at the end of their sentence is the ultimate product.
    Recidivism is the product that defines failure of the system and costs the community way too much.
    Hopefully someday soon a viable alternative will be available.
