I imagine you would take umbrage at a Judge or Magistrate telling you how to drive a truck; no doubt they would be as good at that as you are at telling us how they should do their job.

Now you are just being silly.
Judges are public servants and are open to public scrutiny and most truck drivers work in private enterprise and are not subject to public scrutiny.

I have seen a magistrate (not my relation) attacked in a court room by a violent bloke when refused bail. Another bloke pulled a knife in court. I saw another magistrate's family threatened. Bomb threats against courts are common. Magistrates are usually afraid to live in the towns where they hold sittings. Nothing ivory tower about it at all.

Nothing silly about it at all. The only silly thing here is, unqualified folk who, after reading a headline grab, of dubious accuracy, believing they know how to do a Judge's job better.

What part about when a judge lets someone off without a custodial sentance and they reoffend isn't worthey of criticism?
These people are supposed to be at the top of the legal field so making that sort of misjudgment is unacceptable especially when an innocent gets harmed because of their poor judgment.

So .... you making defamatory statements about all judges ("do-gooder judiciary"), which, as I pointed out, include a number of very hard-working friends of mine, isn't rude.

Your response to me:

Yeah, that's not rude either.

If there's a crime-wave going on - which there is, according to you - then magistrates, and the judges in the higher courts, are very much in the front-line because they're the ones who end up having to deal with it. And I'd point out to you that the police and judiciary have the same approach to this crime-wave, the one that you're labelling "do-gooder". Don't believe me? Have a read of the article I posted about "Operation Wayward".

By the way, it's been shown time and time again that re-offending is less likely when diversion programs are used instead of incarceration. Sure, you can cherry-pick the exceptions but as they say in the law "hard cases make bad law".

Typical Trout, as I've said, certain people on here have to resort to "name calling".
Me, I read the papers, I listen to the news,....is it all false?...how many times do I hear, "repeat bail offender", "not the first time", "repeat offender",....as in the case of so many instances that because of weak Judicial decisions, these people roam free & commit further offences, on too many occasions resulting in innocent Aussies getting hurt, and as was the case in Bourke St recently, murdered. If ya've bothered to read anything at all about this, one of the main issues was, why were these people not in jail in relation to previous crimes committed?

In the Bourne Street case he was on bail because he was only on a minor speeding offence and had no record of violence.
Are we just going to refuse bail to everyone no matter how trivial the offence?
We'd have to build hundreds of new prisons. Forget building roads, schools, hospitals - forget everything except prisons, prisons and more prisons.

And if you ever get to see how things work in the youth centres "these days",you will understand why these young adults continue on with their career of crime, wrecking other peoples lives.

Its a very sad situation that,over the last couple of years has become the norm.

Its now the softly softly system,no discipline,results in no rehabilitation,so how can they ever fit back into society?
